These terms govern your use of lizzyloans.com (the "Site") and the forms, calculators, and content on it. By using the Site you agree to these terms and to our privacy notice. If you do not agree, please do not use the Site.
Who we are and what we do
LizzyLoans LLC ("LizzyLoans," "Lizzy Loans," "we," "us") is a New York limited liability company that works on financing for commercial and investment real estate. We are not a bank, depository institution, or direct lender, and we are not affiliated with any bank or lender. We do not offer consumer, residential, or owner-occupied 1–4 family mortgage loans, and nothing on the Site is directed to consumers seeking credit for personal, family, or household purposes.
Nothing here is an offer, application, or advice
Content on the Site is general information only. It is not an offer or commitment to lend, an extension of credit, a rate quote, a term sheet, an application, or a guarantee of approval. Submitting a form does not create an application, an engagement, a fiduciary or advisory relationship, or any obligation on our part. Any terms are discussed individually and documented separately through the appropriate channels. Nothing on the Site is legal, tax, accounting, or investment advice; consult your own advisors.
Where we operate
Services are offered only where permitted by applicable law. Some states require a license or registration to broker or arrange commercial real estate loans; in those states we either work through appropriately licensed parties or do not offer services. Describing our services as "nationwide" does not mean every service is available in every state, and no service is offered where it would be unlawful.
Calculators and market data
The commercial loan calculator produces illustrations from figures you enter. It runs in your browser, is not a quote, and omits items such as taxes, insurance, escrows, prepayment provisions, and most closing costs. Treasury yields shown on the Site are published by the U.S. Department of the Treasury and are reproduced as reference data without adjustment; we do not warrant their accuracy or timeliness.
Your submissions
When you submit a form, you represent that the information is accurate to the best of your knowledge, that you are at least 18, that you are authorized to act for any entity you name, and that the request concerns a commercial or investment property. Do not submit Social Security numbers, dates of birth, account numbers, or copies of identification through the Site; if you do, we may delete the submission. We may decline to respond to any inquiry for any lawful reason.
SMS / text messaging terms
Program. LizzyLoans LLC sends text messages about inquiries, scheduling, document requests, and loan status to people who opt in. Opting in means checking the "Text me about this request" box on one of our forms, replying to a text from us, or texting us first.
Consent. By opting in you agree that LizzyLoans LLC may send you text messages, including messages sent with automated technology, at the mobile number you provided. Consent is not a condition of purchasing or receiving any service.
Frequency and cost. Message frequency varies by conversation. Message and data rates may apply according to your carrier's plan.
Opt out. Reply STOP to any message to cancel. You will receive one final message confirming you are unsubscribed. To rejoin, reply START or opt in again on a form.
Help. Reply HELP to any message, email capital@lizzyloans.com, or call 516-545-1008.
Carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers include major U.S. carriers; availability may vary.
Privacy. Mobile information collected for SMS consent is not shared with third parties or affiliates for their own marketing purposes. Text messaging originator opt-in data and consent are not sold or shared with any third party. See our privacy notice for how we handle your information.
Acceptable use
You agree not to submit false or misleading information, impersonate anyone, interfere with the Site, scrape or harvest data from it, submit malicious code, or use the Site for any unlawful purpose.
Intellectual property
The Site, its text, graphics, logos, and design are owned by LizzyLoans LLC or its licensors and are protected by copyright and trademark law. You may view and print pages for your own business evaluation. Any other use requires our written permission.
Third-party links and services
The Site may link to third-party sites (for example, the U.S. Department of the Treasury) and uses third-party services described in our privacy notice. We are not responsible for third-party content, terms, or practices.
Disclaimer of warranties
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, completeness, availability, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, LizzyLoans LLC and its members, managers, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or opportunities, arising from your use of the Site or reliance on its content, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to indemnify and hold harmless LizzyLoans LLC from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these terms or your misuse of the Site.
Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Any dispute relating to the Site or these terms will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to their jurisdiction. If any provision is unenforceable, the rest remains in effect.
Changes
We may update these terms at any time by posting a revised version with a new "last updated" date. Continued use of the Site after a change means you accept the revised terms.
